LINAK wins court case against German distributor of Chinese copycat product.
On 24 November 2004, the District Court of Hamburg, Germany granted LINAK A/S an interlocutory injunction against two copies of the LINAK actuators LA28 and LA31.
The copy products are made in China and were offered for sale in Germany by a local distributor. The case is remarkable due to the fact that it does not involve any patent rights.
The Court supported LINAK's view that the two actuators in dispute are design copies of LINAK's well known linear actuators LA28 and LA31. Offering the two copies in dispute for sale in Germany was considered by the Court as an act of unfair competition. No other aspects were involved in the case. |

The injunction was exclusively granted on the mere fact that the two actuators were considered as design copies of LINAK's LA28 and LA31. The Court decision has now become final and legally binding between the parties.
The case is the first outcome of a LINAK management decision, to make an extra effort pursuing copy products. First by attacking the producers of the copy products and if this is not possible due to local legislations, then by attacking distributors of the copy products.
